Abstract:
Section 13(3)(a) of the Building and Construction Industry Security of Payment Act (Cap 30B, 2006 Rev Ed) provides that an adjudication application (“AA”) shall be made within seven days after the entitlement of the claimant to make an AA first arises under s 12. This period for the lodgement of an AA is crucial. In practice, two interpretations of how this period should be computed have surfaced. This article attempts to provide a definitive answer.
