Abstract:
There is inherent tension between rehabilitating individuals where business debts are concerned and fairness to creditors in insolvency proceedings. This article distils insights from the existing personal insolvency framework, recent reforms, and case law. It proposes strengthening institutions, greater alignment with the Model Law, and capacity-building and collaboration across regulators to balance creditors’ interests and legitimate enterprise.
