Abstract:
How does a divorcing spouse’s bankruptcy affect the division of matrimonial assets? How does the law balance creditors’ rights against a spouse’s entitlement to a just and equitable share? Two recent decisions answer these questions from opposite directions. In WZY v Official Assignee [2026] SGHCF 10, bankruptcy preceded the matrimonial orders, leaving the court unable to divide property vested in the Official Assignee. In Farooq Ahmad Mann v Xia Zheng [2026] SGHC 6, pre-bankruptcy transfers were reversed as part of a collusive arrangement to prejudice creditors, without setting aside the matrimonial judgment. This article compares the decisions and draws practical lessons for family and insolvency practitioners.
